On September 20, 2011, the Brazilian authorities decided, after having conducted an expiry review, the continuation of the anti-dumping duty on imports of food grade monocalcium phosphate monohydrate (MCP) from Argentina (Resolução No. 71, 20.09.2011). The product subject to the duty is classified under the following HS code: 2835.2600. The amount of the duty in USD per tonne ranges from 121.00 to 166.55, depending on the exporter. This definitive anti-dumping duty entered into force on October 10, 2011 for a period of five years (from the day of the publication of the resolution in the Federal Official Gazette of Brazil, i.e. up to September 21, 2016). This duty follows an expiry review requested on July 9, 2010 by ICL Brasil Ltda. A review was then initiated by the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade on October 6, 2010 (Circular No. 45, 06.10.2010). The review started on the day of the publication of the circular in the Federal Official Gazette of Brazil, i.e. on October 7, 2010. The original anti-dumping duty entered into force on October 10, 2005 (Resolução No. 33, 05.10.2005).
On 10 October 2016, the Brazilian authorities initiated a sunset review of the anti-dumping duty imposed by Resolução No. 71 of 20 September 2011 on the subject product imported from Argentina (Circular No. 61 of 2016). This review follows a petition lodged on 28 April 2016 byICL Brasil Ltda.
On 9 August 2017, the Brazilian authorities terminated the definitive duties imposed on the subject good from Argentina.
