NoOn October 8th, 2009, the Secretary for Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade decided to initiate a sunset review of the anti-dumping duty imposed on imports of magnesium powder, containing at least 90% of magnesium and 10% lime, from China (Circular Secex No. 52, 08.10.2009). The product subject to investigation is classified under the following HS codes: 8104.3000 and 8104.9000. The application for the review was lodged on May 8th, 2009 by Rima Industrial S/A. The investigation started on the day of the publication of the circular in the Federal Official Gazette of Brazil, i.e. on October 9th, 2009. The existing anti-dumping measure remains in force during the review.
On October 5th, 2010, the Brazilian authorities decided upon the continuation of the definitive anti-dumping duty imposed on imports of magnesium powder originating in China (Resolution Camex No. 74, 05.10.2010). The amount of the duty is USD 0.99 per kilogram. This definitive duty entered into force on the day of the publication of the resolution in the Federal Official Gazette of Brazil, i.e. on October 7th, 2010.The original anti-dumping measure was imposed on October 5th, 2004 by Resolution Camex No. 28 (published in the Federal Official Gazette of Brazil on October 11th, 2004).
On October 2nd, 2015, the Brazilian authorities decided to initiate a sunset review of the anti-dumping measure imposed by Resolution Camex No. 74 dated October 5th, 2010 on imports of magnesium powder from China (Circular Secex No. 62, 02.10.2015). It follows a request lodged on June 5th, 2015 by RIMA Industrial S.A. This sunset review started on the day of the publication of the circular in the Federal Official Gazette of Brazil, i.e. on October 5th, 2015. The existing anti-dumping measure remains in force during the review.
On 21 July 2016, following the conclusion the above-mentioned sunset review, the Brazilian authorities extended the definitive anti-dumping duty on the above good from China (Camex Resolution No. 66). The amount of the duty imposed on imports from China is USD 0.99 per kg. The duty is in force for a period of five years.
On 21 July 2021, the Brazilian authorities announced the initiation of a sunset review of the definitive duty imposed on imports of the subject good from China.
On 18 July 2022, the Brazilian authorities issued a regulation extending the definitive duty imposed on imports of magnesium powder, containing at least 90% of magnesium and 10% lime, from China following the conclusion of the sunset review.
