Anti-dumping

On February 13, 2009, the Indian authorities initiated an anti-dumping investigation on imports of certain phosphorous-based chemical compounds from China and the European Union.
The products subject to investigation are classified under the following HS codes: 2812.1021 (Phosphorous trichloride (PCL3)), 2812.1022 (Phosphorous pentachloride (PCL5)), 2812.1030 (Phosphorous oxychloride (POCL3)), 2920.9041 (Trimethyl phosphite (TMP)) and 2920.9099 (Triphenyl phosphite (TPPI)).
On August 18, 2009, the Indian authorities issued their preliminary findings. They recommended the imposition of a provisional anti-dumping duty only on imports from China of Phosphorous pentachloride (PCL5) classified under HS code 2812.1022. This provisional duty was imposed on October 16, 2009 (Notification No. 119/2009-Customs, 16.10.2009). The amount of the duty ranges from USD 0.326 to USD 0.638 per kilogram, depending on the Chinese producer. This provisional duty is effective upto and inclusive of April 15, 2010.
On April 7, 2010, the Indian authorities issued their final findings. They recommended the imposition of a definitive anti-dumping duty only on imports from China of Phosphorous pentachloride (PCL5) classified under HS code 2812.1022 and of Trimethyl phosphite (TMP) classified under HS code 2920.9041. This definitive duty was imposed on June 18, 2010 (Notification No. 68/2010-Customs, 18.06.2010). The amount of the duty imposed on imports of Phosphorous pentachloride (PCL5) ranges from USD 0.467 to USD 0.777 per kilogram, depending on the Chinese producer. The amount of the duty imposed on imports of Trimethyl phosphite (TMP) ranges from USD 0.008 to USD 0.575 per kilogram, depending on the Chinese producer. The definitive duty imposed on imports of Phosphorous pentachloride (PCL5) is effective for a period of five years with effect from the date of imposition of the provisional anti-dumping duty, i.e. from October 16, 2009. The definitive duty imposed on imports of Trimethyl phosphite (TMP) is effective for a period of five years with effect from the date of publication of the notice in the Gazette of India, i.e. from June 18, 2010.
