On May 9, 2010, the Ministry of Commerce of the People's Republic of China ('MOFCOM') published Notice No. 25 '2010' to initiate an antidumping sunset review investigation on imports of Chloroprene Rubber originating in Japan, the EU and the US as of May 10, 2010.
After one year's investigation, in accordance with Article 48 of Chinese Regulations on Anti-dumping, the MOFCOM released this Notice NO.21(2011) and held that termination of the anti-dumping duty on the said product from the US, EU and Japan, would be likely to lead to recurrence of injury to Chinese domestic Chloroprene Rubber industry. In accordance with this Notice NO.21(2011), import of Chloroprene Rubber originating from the US, EU and Japan shall be levied with anti-dumping duty rate in accordance with Notice NO.23 (2005) and the Notice NO.49 (2010), the anti-dumping duty shall come into effect since May 10, 2011. The anti-dumping duty period shall be effective for 5 years.
On 9 May 2011, the Chinese Ministry of Commerce (MOFCOM) released the Notice NO.21 (2011) announcing the final review determination to levy anti-dumping duty on chloroprene rubber (listed under 40024910, 40024990 in the import tariffs of the Chinese Customs) originating from the US, EU and Japan.
On 10 May 2016, the Ministry of Commerce of the People's Republic of China initiated a sunset review of the anti-dumping duty imposed on imports of the above good from the United States, Japan and the European Union (MOFCOM Announcement No. 18 of 2016). It follows the application lodged on 2 March 2016 by Chongqing Changshou Chemical Co., Ltd and Shanxi Synthetic Rubber Group Co., Ltd. on behalf of the industry of the subject good. The existing anti-dumping duty remains in force during the review period.
On 10 May 2017, the Ministry of Commerce of the People’s Republic of China extended the antidumping duty imposed on imports of the subject good from Japan, the United States and the European Union for a period of five years following the conclusion of the above sunset review. The rate of duty imposed on imports from Japan is between 10.2% and 43.9% depending on the company. The rate of duty on imports from the United States is 151%. The rate of duty on imports from the European Union is between 11% and 151% depending on the company.
