Safeguard

On 25 November 2010, the Russian authorities decided to impose a definitive safeguard duty on imports of caramel. The products subject to duties fall under the following HS code subheadings: 1704.90,710.0, 1704.90.750.0, 1806.90.500.1, 1806.90.500.2, and 1806.90.500.9.

Decree # 175 of the Ministry of Industry and Trade, issued on 5 March 2010, initiated safeguard investigation against imported caramel.
  
Based on the results of the investigation, Russia introduces a safeguard duty for 3 years of USD 294.1 per 1 ton from 26 December 2010. This duty does not apply to the imports from Belarus and from the countries which enjoy Russian national system of preferences (excluding China and India).

On 18 November 2011, the Customs Union Commission issued Decree 856 replacing and thereby terminating the above safeguard duty, see related state act. The Commission imposed the safeguard duty on caramel from 11 January 2012. According to article 4 of the "Agreement on the application of safeguard, antidumping and countervailing measures in transitional period" of 19 November 2010 when a trade defence measure imposed in the Customs Union enters into force the corresponding national measure is terminated. As such, the above safeguard duty was terminated on 11 January 2012.
