Anti-dumping

On February 26th, 2009, the Argentinian authorities decided to initiate an anti-dumping investigation on imports of footwear from China (Resolution 42/2009, 26.02.2009).
The products subject to investigation are classified under the following HS codes: 6401.1000, 6401.9200, 6401.9910, 6401.9990, 6402.1900, 6402.2000, 6402.9110, 6402.9190, 6402.9910, 6402.9990, 6403.1900, 6403.2000, 6403.4000, 6403.5110, 6403.5190, 6403.5910, 6403.5990, 6403.9110, 6403.9190, 6403.9910, 6403.9990, 6404.1100, 6404.1900, 6404.2000, 6405.1010, 6405.1020, 6405.1090, 6405.2000 and 6405.9000.
The investigation started on the day following the publication of the resolution in the Official Journal of the Argentinian Republic, i.e. on March 3rd, 2009.

On July 20th, 2009, the Argentinian authorities decided to impose a provisional anti-dumping duty on imports of footwear originating in China (Resolution 259/2009, 20.07.2009).
The duty takes the form of a mimimum export price FOB of USD 15.50 per pair of shoes. Only sport shoes with soles of materials other than PVC or unvulcanized rubber are not subject to this provisional duty.
This provisional anti-dumping duty entered into force on the day following the publication of the resolution in the Official Journal of the Argentinian Republic, i.e. on July 22nd, 2009, and is applicable for a period of four months.

On March 17th, 2010, the Argentinian authorities decided to impose a definitive anti-dumping duty on imports of footwear originating in China (Resolution 46/2010, 17.03.2010).
The duty takes the form of a mimimum export price FOB of USD 13.38 per pair of shoes.
This definitive anti-dumping duty entered into force on the day of the publication of the resolution in the Official Journal of the Argentinian Republic, i.e. on March 22nd, 2010, and is applicable for a period of five years.

On March 20th, 2015, the Argentinian authorities decided to initiate a sunset review of the above-mentioned anti-dumping measure imposed on imports of footwear originating in China (Resolution 136/2015, 20.03.2015).
This follows the request lodged on December 22nd, 2014 by the Argentinian Chamber of the Shoe Industry (Cámara de la Industria del Calzado).
The existing anti-dumping duty imposed Resolution 46/2010 remains in force during the review.
The investigation started on the day of the publication of the resolution in the Official Journal of the Argentinian Republic, i.e. on March 25th, 2015.
 
On 17 December 2015, the Argentinian authorities decided to extend the definitive anti-dumping duty on imports of the above-mentioned products originating in China following the conclusion of a sunset review (Resolution 1859/2015). The rate of definitive duty imposed by Resolución No. 46/2010, as seen above, is maintained and applicable for a period of five years.
