NoOn 10 May 2011, the European Commission imposed a definitive anti-dumping duty and started collecting provisional duty on imports of melamine originating in China. As its definitive measure, the Commission chose to impose minimum import prices of 1153 Euros/ton net product weight for those companies charged in the initiation of this investigation. All other companies shall be subject to a duty of 415 Euros/tonne net product weight.
On 16 November 2010, the Commission imposed provisional duties from 44.9 to 49.0.
On February 17, 2010, the European Commission initiated an anti-dumping proceeding concerning imports of melamine originating in the People's Republic of China following a complaint lodged by Borealis Agrolinz Melamine GmbH, DSM Melamine B.V. and Zaklady Azotowe Pulawy representing more than 50 % of the total EU's production of melamine. The products subject to investigation are classified under the following HS code subheading: 2933.61.00.
On 11 May 2016, the European Commission initiated a sunset review of the anti-dumping duty imposed on imports of the above products from China (Notice No. 2016/C 167/08). This follows the request lodged on 10 February 2016 by Borealis Agrolinz Melamine GmbH, OCI Nitrogen BV and Grupa Azoty Zaklady Azotow Pulawy SA on behalf of producers representing more than 25% of the total EU production of the subject goods.
On 2 July 2017, the European Commission extended the definitive antidumping duty imposed on imports of subject good from China following the conclusion of the above sunset review. The rate of duty on individually named producers is the difference between the minimum import price of EUR 1153 per tonne and the net, free-at-Union-frontier price, before duty. No duties are imposed if the minimum import price is lower than or equal to the net, free-at-Union-frontier price, before duty. The rate of duty on imports from all other companies is EUR 415 per tonne.
On 1 July 2022, the European Commission announced the initiation of a sunset review of the definitive duty imposed on imports of the subject good from China. This follows the application lodged on 31 March 2022 by Borealis Agrolinz Melamine GmbH, OCI Nitrogen BV, and Grupa Azoty Zaklady Azotowe Pulawy SA.
