On 11 April 2016, the Indian Directorate General of Anti-dumping & Allied Duties, Ministry of Commerce and Industry, initiated an anti-dumping investigation on imports of hot-rolled flat products of alloy or non-alloy steel in coils, sheets and plates with a specific width and thickness exported from China, Japan, Russia, the Republic of Korea, Brazil and Indonesia. The products subject to investigation are classified under the following HS codes: 7208, 7211, 7225 and 7226. This investigation follows the application lodged by Steel Authority of India Limited, JSW Steel Limited and Essar Steel India Limited.
On 8 August 2016, the Indian Ministry of Finance issued the Customs Notification imposing a provisional anti-dumping duty on the above products from China, Japan, Russia, the Republic of Korea, Brazil and Indonesia (Notification No. 44/2016-Customs (ADD), 08.08.2016). The amount of the duty imposed on imports of hot-rolled flat products of alloy or non-alloy steel in coils of a width up to 2100 mm and a maximum thickness of 25 mm originating in or exported from the Republic of Korea, Japan, China, Russia, Brazil and Indonesia is USD 474 per tonne. The amount of the duty imposed on imports of hot-rolled flat products of alloy or non-alloy steel not in coils (i.e. in sheets and plates) of a width up to 4950 mm and maximum thickness of 150 mm originating in or exported from the Republic of Korea, Japan, China, Russia, Brazil and Indonesia is USD 557 per tonne. This provisional duty is in force for a period of six months.
On 7 February 2017, the Indian Ministry of Finance extended the above provisional duty on imports of the subject good from the Republic of Korea, Japan, China, Russia, Brazil and Indonesia for an additional period of two months.
On 11 May 2017, the Indian Ministry of Finance imposed a definitive antidumping duty on the subject good from China, Japan, Russia, the Republic of Korea, Brazil and Indonesia. The rate of duty varies depending on the company producer and exporter. Additionally, the duty varies depending if the product is classified as hot-rolled flat products of alloy or non-alloy steel in coils of a width up to 2100mm and thickness up to 25mm or hot-rolled flat products of alloy or non-alloy steel, not in coils (commonly known as sheets and plates) of a width up to 4950mm and thickness up to 150mm. Both product groups' duties fall under HS codes 7208, 7211, 7225 and 7226. The rate of duty on imports from the Republic of Korea is between USD 478 and 561 per tonne. The rate of duty on imports from Japan is USD 489 or 561 per tonne. The rate of duty on imports from China is USD 489 or 561 per tonne. The rate of duty on imports from Russia is USD 489 or 561 per tonne. The rate of duty on imports from Brazil is USD 489 or 561 per tonne. The rate of duty on imports from Indonesia is USD 489 or 561 per tonne. The definitive antidumping duty is in force for a period of five years from the date the provisional came into force, i.e. on 8 August 2016.
