NoOn 7 December 2015, the Indian Directorate General of safeguards initiated a safeguard investigation on imports of hot-rolled flat sheets and plates (excluding hot rolled flat products in coil) of alloy or non-alloy steel into India. The products subject to investigation are classified under HS code subheading 7208, 7225.40413, 7225.4019, 7225.4020, 7225.4030 and 7225.9900. This follows the application lodged on 28 October 2015 by M/S Steel Authority of India Limited, M/S Essar Steel India Limited, M/S JSW Steel Limited and M/S Jindal Steel & Power Ltd.
On 23 November 2016, the Indian Ministry of Finance issued the Customs Notification imposing a definitive safeguard duty on imports of hot-rolled flat sheets and plates (excluding hot rolled flat products in coil) of alloy or non-alloy steel. The rate of duty is 10% ad valorem (minus any possible anti-dumping duty) from 23 November 2016 for one year. The rate of duty is 8% ad valorem (minus any possible anti-dumping duty) from 23 November 2017 for one year. The rate of duty is 6% ad valorem (minus any possible anti-dumping duty) from 23 November 2018 for 6 months. The rate of duty is only applicable for imports of the subject good with an import price on CIF basis below USD 504 per tonne. The safeguard duty expires on 23 May 2019.
