NoOn 13 February 2016, the European Commission announced the initiation of an anti-dumping investigation on imports of certain seamless pipes and tubes of iron (excluding cast iron) or steel (excluding stainless steel), of circular cross section with an external diameter exceeding 406.4mm, from China (Notice No 2016/C 58/10). The products subject to investigation are classified under the following HS codes: ex. 7304.19.90, 7304.29.90, 7304.39.98 and 7304.59.99.
The complaint was lodged on 4 January 2016 by the Defence Committee of the seamless steel tubes industry of the European Union, on behalf of producers representing more than 25% of the EU production of the subject goods.
On 13 November 2016, the European Commission imposed a provisional anti-dumping duty on imports of the subject good from China (Commission Implementing Regulation (EU) No. 2016/1977 of 11 November 2016). The rate of duty is between 43.5% and 81.1% of the net free-at-Union-frontier price before duty depending on the company. The measure is in force for a period of 6 months.
On 13 May 2017, the European Commission imposed a definitive antidumping duty on imports of the subject good from China. The rate of duty is between 29.2% and 54.9% of the net free-at-Union-frontier price before duty depending on the company.
On 3 September 2019, the European Commission issued Commission Implementing Regulation (EU) 2019/1382 amending the definitive duty imposed on imports of certain seamless pipes and tubes of iron (excluding cast iron) or steel (excluding stainless steel), of circular cross section with an external diameter exceeding 406.4mm, from China if a specific safeguard duty is also imposed on the same good. More specifically, in cases when the definitive safeguard duty of 25% out of quota is applied on the subject good (see related state act), the definitive antidumping duty is reduced. The rate of reduced definitive duty is between 4.2% and 29.9%. This decision follows a notice issued in April 2019 and following comments from interested parties.
On 12 May 2022, the European Commission announced the initiation of a sunset review of the definitive duty imposed on imports of the subject good from China. This follows the application lodged on 10 February 2022 by the European Steel Tube Association.
