Public procurement localisation

On 18 January 2014 entered into force Law of the Republic of Kazakhstan dated 14 January 2014 No. 161-V. It introduces the following major changes in the public procurement rules:

  • A national procurement regime was introduced under which foreign suppliers obtain the right to participate in public procurement on equal terms with the local suppliers. This equal treatment is only granted on the existence of an international treaty ratified by Kazakhstan and the home country of the applicant. For the time being, only Belarusian and Russian companies benefit from the national regime.

 

  • The Government is authorised to allow only supplies of local goods and services for public procurement purposes in order to protect the domestic market. It may also ban the access to public procurement for suppliers originating from certain countries, impose restrictions on the access of goods and services, provided by foreign suppliers and determine special conditions for access to public procurement of goods and services, provided by foreign suppliers.
