Import-related non-tariff measure, nes

On 22 July 2014, Royal Decree No. 34/2014 of the Sultan of Oman came into force, amending the country's Commercial Agencies Law. Two main changes are contained in the document:

  1. Whereas the previous regime favoured local commercial agencies, their monopoly has been broken by the new Royal Decree. A foreign natural or legal person may henceforth sell his goods in Oman without being obliged to use a local commercial agent. In addition, commercial agency agreements are no longer automatically renewed.
  2. The number of commercial agreements a business can enter into with local agents can be limited if there are signs it has a market monopoly, e.g. when the multitude of commercial agreements a business has in place impacts negatively on price or supply. In addition, the Minister of Commerce and Industry is restricted in his powers to impose import bans.
