Labour market access

On September 6, 2013, the Vietnamese Ministry of Labour, Invalids and Social Affairs adopted. Decree 102/2013/ND-CP. It authorises the exemption of skilled foreign workers from the obligation to obtain a work permit. The following categories of foreign workers benefit from the measure:

  • Teachers working for foreign universities or organisationsin Vietnam. 
  • Foreigners who hold a Master's Degree orequivalent and work in the area of consultation, teaching, research at educationalorganisation for a period of less than 30 days. 
  • Foreigners that work for foreign centralauthorities or cent political/social organisations.

 
In addition, the new decree introduces the new category 'Technical Workers' (previously, the only acceptable positions were for managers, executives or experts). Technical Workers can be assigned to work in Vietnam provided that they possess qualifications of at least 1 year of study/training in a technical field and a minimum of 3 years of labour experience in the respective field. 
 
Decree 102/2013/ND-CP will take effect on November 1, 2013.
