India: Final antidumping duty imposed on bus and truck radial tyres originating in China and Thailand - mid-term review
Description
On 21st October 2008 India initiated anti-dumping investigation concerning imports of bus and truck radial tyres originating in or exported from China and Thailand.
Automotive Tyre Manufacturers’ Association (ATMA) have filed an application before the Designated Authority, alleging dumping of New/Unused Pneumatic Radial Tyres, with or without Tubes and Flaps of rubber used in buses and lorries, originating in or exported from China PR and Thailand and requested for initiation of Anti Dumping investigations for levy of anti-dumping duties on the subject goods. The present petition has been filed by 3 ATMA members, Apollo Tyres, J.K. Tyres Ltd. and MRF Ltd. They claimed that there is no difference in the subject good produced by the domestic industry and the subject product imported from the subject country.
Having initiated and conducted an investigation into dumping, injury and casual links between dumping and injury to the domestic industry caused by dumped imports, the authority took the decision to impose the final duty is required to offset dumping and injury pending completion of the investigation. (MOC Notification 1 Jan 2010).
The government of India revisited the duty in 2010. The meeting called by MoC’s Deptt. of Industrial Policy and Promotion. According to the sources, reports of shortages of radial truck/bus tyres faced by both automakers may have prompted the Govt to have further discussions on the subject. Update of August 26, 2010:
On August 26, 2010 the Ministry of Commerce and Industry issued a document "Mid-Term Review investigation regarding anti-dumping duty imposed on imports of ‘Bias Tyres for Bus and Lorries/Trucks’ originating in or exported from China PR and Thailand – Final Findings" increasing the current level of duties.
